- Client – a natural or legal person who orders a service through the website.
- Media – an online publication or website from the Provider’s catalogue in which the material is published.
- Material – text, images and links provided by the Client or prepared at the Client’s request.
Services
The Provider offers:
- distribution of press releases to media;
- arranging paid publications (PR articles, guest posts) in Media chosen by the Client;
- preparation of texts, where this has been expressly agreed.
The Provider acts as an intermediary between the Client and the Media. It does not own the Media and does not determine their editorial policy.
Ordering and conclusion of the contract
- The Client sends an enquiry through the contact form, by email or through the price list on the website.
- The Provider confirms by email the selected media, the price, the timeframe and the terms.
- The contract is deemed concluded when the Client confirms the offer in writing and pays the amount due, unless the parties agree otherwise.
The information on the website, including the catalogue of media and prices, is not a binding offer. It may be changed without notice until a specific order has been confirmed.
Prices and payment
- All prices on the website are in euro and exclude VAT, unless expressly stated otherwise.
- Payment is made in advance, by bank transfer, against an issued invoice.
- Performance begins after the payment has been received in the Provider’s account.
Performance and timeframes
- The timeframes stated on the website are indicative. The specific timeframe is confirmed for each order.
- The timeframe starts to run from the moment the Client has provided all necessary materials and has made the payment.
- After publication, the Provider sends the Client a report with the URLs of the publications.
- The period for which the material remains published depends on the policy of the respective Media.
Editorial approval
Each Media has the right to review the Material and to request changes or to refuse to publish it. The Provider does not guarantee that a particular text will be accepted without editing.
If a Media refuses, the Provider offers the Client one of the following options:
- editing the Material in line with the Media’s requirements;
- publication in another, equivalent Media;
- a refund of the amount paid for the respective publication.
Obligations of the Client
The Client undertakes:
- to provide accurate information and materials for which it holds the necessary rights;
- not to provide content that is unlawful, misleading, infringes third-party rights or offends good morals;
- to comply with the applicable advertising rules, including those for financial services, gambling, food, medicines and other regulated activities.
The Client is responsible for the content of the Material it provides and for any damage resulting from a breach of these obligations.
Links and metrics
- The number and type of links in a publication are determined by the policy of the respective Media and are specified when the order is placed.
- The metrics in the catalogue (Domain Rating, referring domains, traffic and others) come from external sources, are indicative and may change.
- The Provider does not guarantee a particular search engine ranking, indexing, number of visits or commercial result from a publication.
Cancellation and refunds
- The Client may cancel the order at no cost before the Material has been sent to the Media.
- Once the Material has been published, the service is deemed performed and the amount paid is not refundable.
- Where the Client is a consumer within the meaning of the Bulgarian Consumer Protection Act, the Client has the right to withdraw from the contract within 14 days. This right lapses once the service has been fully performed with the Client’s express prior consent.
Intellectual property
The content of the website send-press.com – texts, graphics, logo and structure – belongs to the Provider and may not be used without its consent. The Client retains the rights in the materials it provides and grants the Provider the right to use them for the purposes of performing the order.
Limitation of liability
The Provider is not liable for:
- acts or omissions of the Media, including changing, moving or removing material that has already been published;
- changes in the metrics of the Media or in search engine algorithms;
- temporary unavailability of the website for reasons beyond its control.
In all cases the Provider’s liability is limited to the amount paid by the Client for the respective service.
Personal data
The Provider processes Clients’ personal data in accordance with the Privacy Policy published on the website.
Amendments
The Provider may amend these terms and conditions. Amendments take effect when published on the website and do not affect orders that have already been confirmed.
